Dear Sir or Madam:

This letter documents the results of an investigation performed with respect to the transportation of (1) rail tank car which exceeded the 45 day time limit for notification of receipt from the disposal facility as specified in 10 CFR Part 20, Appendix G, as exempted. The investigation, which was completed on March 27, 2023, determined that the shipment was traced on a daily basis by the various carriers such as the New England Central Railroad, CSX, Union Pacific (UP), and Texas & New Mexico Railway (TXN), the disposal facility of Waste Control Specialist and the Vermont Yankee waste operations personnel.

10 CFR 20, Appendix G, "Requirements for Transfers of Low-Level Radioactive Waste Intended for Disposal at Licensed Land Disposal Facilities and Manifests,"Section III.A(9) states for any shipments or any part of a shipment for which acknowledgment of receipt has not been received within the times set forth in this appendix, conduct an investigation in accordance with Section 111.E of this appendix.

BW 23-007 / Page 2 of 2 Investigation On December 7, 2022, one rail water tank car departed from the NorthStar Vermont Yankee (VY) site at 320 Governor Hunt Road in Vernon, Vermont to the Waste Control Specialists disposal facility in Andrews, Texas.

On December 19, 2022, the rail tank car was damaged during handling by CSX in the Avon, Indiana rail yard. The rail tank car was inspected and while the contents were unaffected, it was determined that the tank car was too badly damaged to be kept in service. CSX, ICE Logistics, and VY developed plans to transfer the water from FURX123730 to a second rail tank car FURX125635. The water transfer was completed on February 27, 2023. Rail car FURX125635 was inspected, marked, labeled, placarded, and surveyed on February 28, 2023 by VY personnel. VY released rail tank car FURX125635 to ICE Logistics for shipment to WCS on March 2, 2023, and the rail tank car was placed at the WCS site on March 16, 2023. VY received the signed 540 manifest indicating receipt of the shipment on March 27, 2023 (110 th day).

Northstar Vermont Yankee and Waste Control Specialists receive daily tracking reports from the railroad logistics contractor, I.C.E. Service Group, for all waste shipments transported by rail from the VY site.

The location of the subject shipment was verified and traced until receipt at the destination facility.

Northstar Vermont Yankee and Waste Control Specialists (WCS) tracked the progress of this shipment through the daily trace reports. At no time was the shipment lost or in an unknown location.

Below is the summary for the rail shipment that exceeded the time provided in 10 CFR 20, Appendix G (as exempted). The summary includes the shipment identification (Manifest) number, rail car identification (ID) number, shipment date, date of receipt at the waste disposal facility and the total number of days the shipment was in transit.
