Dear Sir or Madam:
On March 12, 2010, Entergy Nuclear Operations, Inc. (ENO) submitted a proposed amendment to Operating License DPR-28 for Vermont Yankee Nuclear Power Station (VY) as indicated by Reference 1. The proposed changes would have revised License Renewal Commitment (LRC)
Nos. 3, 6, 16 and 19. The amendment request was submitted because VY Renewed Facility Operating License Condition 3.Q required NRC approval to make changes to a LRC.
In Reference 2, the NRC approved changes to License Conditions 3.P and 3.Q that will allow VY to make changes to LRCs provided that they are evaluated in accordance with the requirements of 10 CFR 50.59. Based on this, ENO is withdrawing the license amendment request. The 10 CFR 50.59 evaluations will determine if re-submittal is required.
This letter contains no new regulatory commitments.
