Millstone Nuclear Power Station, Unit No. 3 Change in Ownership Interest of the City of Burlington, Vermont .

and Connecticut Municipal Electric Energy Cooperative in Millstone Unit No. 3

'i Pursuant to 10CFR50.90, Northeast Nuclear Energy Company (NNECO) hereby proposes to amend its Facility Operating License, NPF-49 by deleting the name of the City of Burlington, Vermont as one of the owners in the facility (Millstone Unit No. 3).

l In a letter dated February 13, 1989, the City of Burlington informed the NRC  ;

of a transfer of a minor percentage ownership share between two of the  :

existing licensees of Millstone Unit No. 3 (Reference (1)) effective as of February 15, 1989. Specifically, the change involves the transfer of the 0.0435 percent joint ownership interest of the City of Burlington, Vermont to the Connecticut Municipal Electric Energy Cooperative (CMEEC) The transfer will be considered closed in full at such time as the terms of an escrow agreement referring to compliance with the NRC requirements for approval of the transfer have been met. Both the City of Burlington and the CMEEC have been associate participants in Millstone Unit No. 3 as provided in the Sharing Agreement dated September 1, 1973. This transfer involves a very small percentage of the ownership. This transfer is in accordance with Section 22 of the Sharing Agreement as the City of Burlington offered its share to the other lead and associate participants within the time frame for decision provided in the Sharing Agreement. Only the CMEEC expressed interest in purchasing the City of Burlington's share. This transfer is similar, in all significant respects, to the transaction approved in Reference (2). The operating license for Millstone Unit No. 3 includes a list of the joint

! owners. Since with the transfer, the City of Burlington will no longer have /

Significant Hazards Consideration l

In accordance with 10CFR50.92, NNEC0 has reviewed the proposed change and concluded it does not involve a significant hazards consideration. The basis i for this conclusion is that three criteria of 10CFR50.92(c) are not  !

compromised. The proposed change does not involve a significant hazards j consideration because the change would not:

1. Involve a significant increase in the probability or consequences of an  !

accident previously analyzed. As a result of the proposed amendment, there will not be physical changes to the facility and all Operating ,

Procedures, Limiting. Conditions for Operation (LCO), Limiting Safety l System Settings and Safety Limits specified in the Technical ,

Specifications will remain unchanged. There will be no changes to the l operating organization or personnel as a result of 'the transaction ,

described herein. 1

2. Create the possibility of a new or different kind of accident from any  !

previously analyzed. Since there are no changes in the way the plant is operated, the potential for an unanalyzed accident is not created. No new failure modes are introduced.

3. Involve a'significant reduction in a margin of safety. Plant safety margins are established through LCO, Limiting Safety System Settings and Safety Limits specified in the Technical Specifications. Since there will be no change to either the physical design of the plant or to any of these settings and limits, there will be no change to any of the margins of safety.

t Moreover, the Commission has provided guidance concerning the application of standards set forth in 10CFR50.92 by providing certain examples (March 6, 1986, 51FR7751) of amendments that are considered not likely to involve a significant hazards consideration. The proposed change is enveloped by Example (viii), a change to a license to reflect a minor adjustment in  !

ownership share among co-owners. As stated earlier, both the City of Burlington and the CMEEC are associate participants in the facility as provided in the Sharing Agreement. The transfer involves a very small (0.0435 (

percent) percentage of the ownership and is in accordance with Section 22 of l the Sharing Agreement. '

Based upon the above 'and the information in this submittal, there are no significant radiological or nonradiological impacts associated with the 4 proposed amendment, and the proposed amendment will not have a significant effect on the quality of the human environment.

The Millstone . Unit No. 3 Nuclear Review Board has reviewed' and approved the I proposed amendment.and concurred with the above determination.

Regarding our proposed schedule for this amendment, we request issuance at l your earliest convenience with the amendment effective upon issuance.

In accordance with 10CFR50.91(b), we are providing the State of Connecticut with a copy of the proposed amendment.

1. The Nuclear Regulatory Commission (the Commission) has found that:  ;

A. The application for license filed by Northeast Nuclear Energy Company, as agent and representative of 14 utilities listed below -

and hereafter referred to as licensees, complies with the standards and requirements of the ; Atomic Energy Act of.1954, as' amended (the Act), and the. Commission's regulations set forth in 10 CFR Chapter' I, and all required notifications to other agencies or bodies have been duly made; B. Construction of Millstone Nuclear Power Station, Unit No. 3 (the facility) has been substantially completed in conformity with Construction Permit No, CPPR-113 and the application, as amended, the provisions of the Act, and the regulations of the Commission; C. The ' facility will operate in conformity with the . application, as amended, the provisions of the Act, and the regulations of the Commission, '(except as exempted from compliance, see Section 2.D below);

D. There is reasonable assurance: (1) that the activilles authorized by this operating license can be conducted without endangering the health and safety of the public, and (2) that such activities will be conducted in compliance with the Commission's regulations set forth in .10 CFR Chapter I, (except as exempted from compliance, see Section 20 below):

• Northeast Nuclear Energy Company is authorized to act as agent and representative for the following Owners: Central Maine Power Company, Central Vermont Public Service Corporation, Chicopee Municipal Lighting Plant, Connecticut Municipal Electric Energy Cooperative, The Connecticut Light and Power Company, Fitchburg Gas and Electric Light Company, Massachusetts Municipal Wholesale Electric Company, Montaup Electric Company, New England Power Company, Public Service Company of New Hampshire, The United Illuminating Company, The Village of Lyndonville Electric Department, Western Massachusetts Electric Company, and Vermont Electric Generation and Transmission Cooperative, Inc., and has exclusive responsibility and cuntrol over the physical construction, operation and maintenance of the facility.
