I and 2 Proposed Revisions to Technical Specifications Response to Generic Letter No. 83-43 Pursuant to 10 CFR 50.90, Connecticut Yankee Atomic Power Company (CYAPCO) and Northeast Nuclear Energy Company (NNECO) hereby propose to amend their Operating Licenses, DPR-61, DPR-21, and DPR-65, by incorporating the attached proposed changes into the Haddam Neck, Millstone Unit No. I and Millstone Unit No. 2 Technical Specifications. These proposed changes are in response to the notice which advised that 10 CFR 50.72 and 10 CFR 50.73 would be revised to reflect changes to the immediate notification requirements and the Licensee Event Report Systeml. The attached proposed Haddam Neck Plant2 changes proposed by CYAPCO supersede the changes submitted May 2,1983 for Technical Specification Section 6.9.

The proposed Technical Specifications changes are provided as Attachments 1,2, and 3, for the Haddam Neck Plant, and Millstone Unit Nos. I and 2, respectively.

These proposed changes define " Reportable Events" and alter reporting requirements as a result of changes to 10 CFR 50.72 and 10 CFR 50.73. The l proposed changes delete the term " Reportable Occurrence", and add the term

" Reportable Event", that is defined as any of those conditions specified in Section 50.73 to 10CFR Part 50. The proposed changes will clarify the list of reportable events and provide the NRC with more useful reports regarding the safety of operating nuclear power plants.

t 3 in accordance with 10 CFR 50.59, CYAPCO and NNECO have reviewed the attached proposed changes and have determined that they do not constitute an unreviewed safety question. Specifically, the margins of safety as defined in the Technical Specification Bases are maintained. In addition, the probability of occurrence or the consequences of previously analyzed accidents have not been increased and the possibility for a new type of accident not previously evaluated has not been created. The proposed changes are a result of a recent change to 10 CFR 50.73 which establishes " Reportable Events" for which reports must be submitted to the Nuclear Regulatory Commission.

In accordance with 10 CFR 50.92, CYAPCO and NNECO have reviewed the proposed changes and have concluded that they do not involve a significant hazards consideration. The basis for this conclusion is that the criteria of 10 CFR 50.92(c) are not compromised, a conclusion which is supported by our determinations made pursuant to 10 CFR 50.59. Additionally, the Commission has provided guidance concerning the application of standards in 10 CFR 50.92 by providing certain examples (48 FR 14870, April 6,1983). The proposed changes fall within the envelope of the example (vii), a change to make a license conform to changes in regulations, where the license change results in very minor changes to facility operations clearly in keeping with the regulations. The proposed changes define " Reportable Events" and alter reporting requirements as a result of changes to 10 CFR 50.72 and 10 CFR 50.73. These changes are administrative, conform. to the changes in regulations and, in particular, implement the provisions of 10CRF50.73(g).

The Haddam Neck Nuclear Review Board and Millstone Site Nuclear Review Board have reviewed and approved the attached proposed changes and concur with the above determinations.

I In accordance with 10 CFR 50.91(b), CYAPCO and NNECO are providing the State of Connecticut copies of these proposed amendments.

As stated in the letter dated December 29,1983, because these proposed changes to the Technical Specifications are clarifying in nature and were made at the request of the Commission, a license fee is not required.
