Items of Interest Week Ending October 30, 2020 U.S. Nuclear Regulatory Commission Hosted Public Meeting to Discuss Revisions to NUREG-1021 On October 22, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff hosted a public teleconference with industry representatives (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20282A237) to discuss proposed changes to simulator operating test grading on initial operator licensing examinations, operator education and experience requirements for licensed operator applicants, and an update on draft NUREG-1021, Revision 12. The industry representatives presented their concerns with certain aspects of the revised grading approach to the simulator operating test. The staff presented the safety and regulatory bases for the proposed changes and the results of a regrade study using previous exam results that predicts a minimal impact on examination pass rates. The staff expects to issue the draft NUREG-1021, Revision 12, for public comment this November. The staff plans to discuss all changes to draft NUREG-1021 in a public meeting held during the open comment period.

NRC Hosted Public Workshop with Technical Specification Task Force On October 29, 2020, NRC staff and the industry-led Technical Specifications Task Force (TSTF) hosted a public workshop (ADAMS Accession No. ML20289A443) to discuss proposed changes to standard technical specification Limiting Condition for Operation (LCO) 3.0.3. This LCO requires a relatively rapid plant shutdown when no other action is provided for a given condition. The TSTF proposes additional time between entry into LCO 3.0.3 and plant shutdown for cases where such additional time may be warranted, or even enhance safety, based on assessment and management of risk. Staff asked clarifying questions and provided feedback during the workshop, which the TSTF will consider as they draft a proposed generic change to the standard technical specifications. A pre-submittal meeting for their proposed generic change is planned in the first quarter of calendar year 2021.

NRC Held Public Meeting with the Reactor Oversight Process Industry Task Force On October 28, 2020, NRC staff held a public meeting (ADAMS Accession No. ML20302A065) with the industrys Reactor Oversight Process (ROP) Task Force to discuss the status of topics, including updates on Performance Indicator (PI) Frequently Asked Questions (ADAMS Accession Nos. ML20106D694, ML20223A373, ML20288A499, and ML20288A404),

Modification of the Description of Unplanned Scrams with Complications PI to Reflect AP1000 Design (ADAMS Accession No. ML20274A258), Supplemental Inspection Procedures (ADAMS Accession No. ML20295A347), Cross Cutting Issues (ADAMS Accession No. ML20297A253),

Problem Identification and Resolution, Operator Performance Trends (ADAMS Accession No. ML20297A361), and Inspection Manual Chapter 0609, Appendix A (ADAMS Accession Number ML20295A269). The next monthly public meeting between the staff and the ROP Task Force is scheduled for November 18.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the NOVEMBER 17, 2020 ENCLOSURE C

pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending October 30, 2020 NMSS Staff Held Public Meeting on Cumulative Effects of Regulation On October 28-29, 2020, the staff conducted its quarterly meeting on Cumulative Effects of Regulation with Nuclear Energy Institute (NEI) and Nuclear Fuel Cycle industry representatives and members of the public. The purpose of the meeting was to discuss the status of several regulatory initiatives involving the nuclear fuel cycle industry. Topics discussed during the meeting included: updates to the schedule, NRC COVID-19 response; remote and follow-up on-site inspections feedback and lessons-learned; industry feedback on the exemption process; the status of draft NUREG-2159 on the MC&A Plan for Category II materials; credit/flexibility for good performance; status of the Smarter Licensing Program, status of inspection modifications; the fuel cycle Operating Experience Program; status of non-fee billable work; status of efforts on low safety significance issues; and the 2021 Regulatory Information Conference. The next public meeting with NEI and the nuclear fuel industry representatives is scheduled for the spring of 2021.

NMSS Staff Issued Technical Evaluation Report for Veterinary Treatment On October 30, 2020, NMSS staff issued the technical evaluation report for Exubrion Therapeutics' (Exubrion) proposed procedure for the release of dogs following treatment with a tin-117m colloid (ADAMS Accession No. ML20269A274). Staff found that Exubrions treatment and release procedure provides reasonable assurance that the public dose limits will not be exceeded.

Miscellaneous Corrections: Final rule, Correction; Chapter I of Title 10 of the Code of Federal Regulations (10 CFR) [RIN 3150-AK48; NRC-2020-0125;]

On October 28, 2020, the NRC published a notice in the Federal Register (85 FR 68243) correcting a final rule that appeared in the Federal Register on October 16, 2020 (85 FR 65656).

The NRC is amending its regulations to make miscellaneous corrections. These changes include redesignating footnotes, correcting references, typographical errors, nomenclature, titles, email addresses, and contact information. This action is necessary to correct an error that appeared in Instruction 8 of the final rule. This correction is effective on November 16, 2020.

Availability of NUREG/BR-0006 and NUREG/BR-0007; NUREG; Issuance; 10 CFR Parts 40, 74, 75, and 150 [NRC-2019-0108]

On October 30, 2020, the NRC published a notice in the Federal Register (85 FR 68722) issuing NUREG/BR-0006, Revision 9, Instructions for Completing Nuclear Material Transaction Reports, and NUREG/BR-0007, Revision 8, Instructions for the Preparation and Distribution of Material Status Reports. These NUREG brochures provide guidance for licensees submitting material transaction reports and material status reports to the Nuclear Materials Management and Safeguards System. NUREG/BR-0006, Revision 9 and NUREG/BR-0007, Revision 8 and its forms became effective on August 31, 2020.
