Items of Interest Week Ending OCTOBER 09, 2020 Staff Hosted Public Meeting Regarding on Leveraging Risk Insights for Aging Management Program Implementation On October 1, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting with the Nuclear Energy Institute (NEI) and the Electric Power Research Institute (EPRI) to discuss leveraging risk insights for aging management program implementation (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20262H244). During the meeting, EPRI presented its recent work products, which may apply to NRC licensees whose licenses have been renewed for an extended operating period from 40 to 60 years or subsequently from 60 to 80 years. The EPRI presentation included information on identifying suitable aging management programs and collecting plant specific information on structures, systems and components, aging management, aging mechanisms, risk insights, operating experience, and additional research that might be needed. The presentation also addressed an approach consisting of the consideration of likelihood and consequences, the use of a risk matrix, review of aging management strategies, regulatory implications, and potential approaches to leveraging risk insights, for the development of new aging management strategies.
Staff Issued Results of the Effectiveness Review of the Reactor Oversight Process Cross-Cutting Issues Program On October 2, 2020, the results of the effectiveness review of the reactor oversight process (ROP) cross-cutting issues (CCI) program was released to the public (ADAMS Package Accession No. ML20239A806). The report documents an internal teams assessment of the effectiveness of the CCI program and offers some program improvements for consideration.
Office of Nuclear Reactor Regulation, Office of Nuclear Security and Incident Response, and Regional Office review and discussion is planned to determine next steps based on the recommendations, including public meetings and potential Commission notification requirements. An opportunity for discussion with the public on the contents of the report is planned for an upcoming ROP task force public meeting on October 28, 2020.
Staff Participated in Department of Energy Public Forum on Developing a Regulatory Framework for Commercial Fusion Reactors On October 6, 2020, the Department of Energy (DOE) Office of Science, Fusion Energy Sciences, held a public forum with over 190 participants on developing a regulatory framework for commercial fusion reactors. The NRC staff and Fusion Industry Association (FIA) helped organize and moderate the forum (ADAMS Accession No. ML20261H399). The NRC staff will coordinate future meetings with DOE, FIA, and other stakeholders to support developing options for Commission consideration on a framework for regulating commercial fusion facilities.

Staff Hosted Public Meeting on Incorporating Risk Insights into 10 CFR 50.59 Evaluations On October 8, 2020, NRR staff conducted a public meeting with NEI and other industry representatives to discuss incorporating risk insights into Title 10 of the Code of Federal Regulations (10 CFR) 50.59, Changes, tests and experiments, evaluations (ADAMS Accession No. ML20268B313). Staff delivered feedback related to NEIs August 5, 2020, presentation, specifically on the use of probabilistic risk assessment techniques and applicability of General Design Criteria language and provided an update regarding the development of 50.59-related inspection guidance (ADAMS Accession No. ML20282A278). NEI presented a topic related to clarifying the application of methods of evaluation in NEI 96-07, Guidelines for 10 CFR 50.59 Evaluations (ADAMS Accession No. ML20281A252). Staff and participants asked clarifying questions and both parties plan to respond to questions posed during this meeting at a public meeting in November.
Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period is summarized below. Items of Interest Week Ending OCTOBER 09, 2020 NMSS Staff Issued Amendment Transferring Crystal River License On October 1, 2020, the staff issued the conforming amendment transferring the Crystal River 3 license from Duke Energy to ADP CR3, a subsidiary of Accelerated Decommissioning Partners, for the purpose of decommissioning. The order approving the transfer was issued on April 1.
Duke Energy will remain the owner of the plant, property and equipment, and will retain ownership and control of the decommissioning trust fund. ADP CR3 plans to complete decommissioning of the site by 2027.
NMSS Staff Issued 13 State Agreement Procedures On October 2, 2020, NMSS staff issued final versions of 13 state agreements procedures to implement the revised Management Directive 5.6, Integrated Materials Performance Evaluation Program (IMPEP), which was issued in July 2019. Nineteen Agreement State participants from 11 Agreement States and 21 U.S. Nuclear Regulatory Commission (NRC) personnel from Region I, Region III, Region IV, and NMSS revised these procedures for interim use beginning in January. The procedures were finalized after seven months of use to incorporate experience gained during IMPEP reviews.
NMSS Staff Held Public Meeting on Proposed Texas Interim Storage Facility On October 6 and 8, 2020, the NRC staff held its second and third public meetings via webinar and teleconference on the draft environmental impact statement (EIS) for the Interim Storage Partners (ISP) proposed consolidated interim storage facility (CISF) in Andrews County, Texas.
To address feedback from the public, the staff used video capabilities to allow the public to see members of the staff during the webinar. Both public meetings lasted over 3 hours3.472222e-5 days <br />8.333333e-4 hours <br />4.960317e-6 weeks <br />1.1415e-6 months <br /> and approximately 100 individuals participated in each with almost 30 people providing verbal comments in each meeting. Several commenters requested in-person public meetings be held after the COVID-19 public health emergency has ended. The NRC will hold the final public meeting to gather comments on October 15, 2020. The public comment period ends November 3, 2020.
NMSS Staff Authorized Shipment of Fresh Fuel Assemblies On October 9, 2020, the staff authorized shipment of Framatome Boiling Water Reactor ATRIUM 10XM fresh fuel assemblies, equipped with inert test rods, to support the development of the Enhanced Accident Tolerant Fuels (eATF). The eATF test rods consist of several segments, with different test configurations, including: Zircaloy 2 cladding with chromium/titanium coatings and containing Zircaloy 2 slugs, and perforated cladding containing silicon carbide test articles. The staff review confirmed the Model No. TN-B1 transportation package design, which is not changed from its current approval, can safely ship up to two modified fuel assemblies. Framatome is planning for one shipment of four modified fuel assemblies in February 2021.

NMSS Staff Issued Updated Schedule for Environmental Review of Proposed Texas Facility On October 9, 2020, the staff issued a letter to ISP to notify them of the revised schedule for the completion of the environmental review of the license application for a proposed CISF located in Andrews County, Texas. The letter states that, in response to the COVID-19 public health emergency, the NRC extended the draft EIS comment period. The schedule related to the safety and security aspects of the staff review remains unchanged, and the staff expects to complete the final safety evaluation report by May 2021.
Measurement and Control of Combustible Gas Generation and Dispersal: Petition for Rulemaking; Denial; Part 50 of Title 10 of the Code of Federal Regulations (PRM-50-103; NRC-2011-0189]
On October 6, 2020, the NRC published a notice in the Federal Register (85 FR 63069) denying a petition for rulemaking (PRM)-50-103, dated October 14, 2011, submitted by Mr. Jordan Weaver (the petitioner) on behalf of the Natural Resources Defense Council, Inc.
The petitioner requested that the NRC amend its regulations regarding the measurement and control of combustible gas generation and dispersal within a power reactor system. The NRC is denying the petition because the issues raised by the petitioner had been considered by the NRC in other NRC processes, and the petitioner presented no sufficient new information or arguments to warrant the requested changes to the regulations. The docket for the petition for rulemaking, PRM-50-103, was closed on October 6, 2020.
