INSPECTION NO. 070-03078/99-001 AND NOTICE OF VIOLATION j

Dear Mr. McAnuity:

On March 24, #999, Keith (mwn and Pamela Henderson of this office conducted a safety

!nspection at Roy F. Weston, Inc., West Chester, Pennsylvania of activities authorized by the

above litbd NRC license. The inspection was an examination ol'your licensed activities as they l relate to radiation safety and to compliance with the Commission's regulations and the license conditions. The inspection consisted of observations by the inspector, interviews with personnel, and a selected examination of representative records. Additionalinformation i provided in the telephone conversation on May 11,1999, between you and Keith Brown of this office was also examined as part of the inspection. The findings of the inspection were also discussed with you during that conversation.

Based on the results of this inspection, it appears that your activities were not conducted in full I compliance with NRC requirements. A Notice of Violation is enclosed that categorizes the j l

violation by severity level in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,l(Enforcement Policy), NUREG 1600. You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. Unless the individuals listed on the license again become involved in your licensed activities, your corrective action must include submission of an appropriate amendment to replace the Radiation Safety Officer and authorized users listed on your license. After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
