Acceptance Review Results for the Entergy Operations Inc. LAR dated February 24, 2010. Plant: Waterford Steam Electric Station, Unit 3 Docket No.: 50-382

Billy/Bob:

By letter dated February 24, 2010, Entergy Operations, Inc. (Entergy) submitted a License Amendment Request (LAR) for "Operating License Condition 2.C.14 (Fuel Movement in the Fuel Handling Building) Deletion."

The application stated that the proposed amendment deletes Operating License Condition 2.C.14 (Fuel Movement in the Fuel Handling Building) due to the licensee electing to comply with 10 CFR 50.68 requirements. The Operating License Condition 2.C.14, "no more than one fuel assembly shall be out of its shipping container or storage location at a given time" was one basis for the, exemption from the criticality alarm system requirements of 10 CFR 70.24. The criticality accident requirements can be met either by complying with 10 CFR 70.24 or 10 CFR 50.68 requirements and since the 10CFR50.68 criteria are now being used, so the Operating License Condition 2.C.14 is no longer applicable.

The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this LAR. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant. The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed LAR in terms of Code/Regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
