ByDecember1,1977thepermittee willsubmitareporttoEPAandNYSDECwhichcontainsrecommendations forfutureoperation oftheintakesystembasedupontheresultsofthosestudies.Intheeventthepermittee doesnotrecommend modification (eitherphysicaloroperational) oftheexistingintakesystem,thepermittee shallfullydescribethealternative measuresitconsidered anditsreasonsfornotrecommending adoptionofanyorallofthosemeasures.

Suchreportshallidentifyeachproductbychemicalformulaand/orcomposition, annualconsumption, frequency ofuse,maximumuseperincident, effluentconcentration, bioassayandtoxicitylimitsandprocedures foruse.Approvalshallonlybegrantedforthosecircumstances andusewhichdonotcontravene NewYorkStateWaterQualityStandards.

14.Non-ComliancewithConditions.
Intheeventthepermittee isunabletocomplywithanyoftheseconditions, due,amongotherreasons,to:(1)Breakdown of~astetreatment equipment, (biological andphysical-chemical systemsincluding, butnotlimitedto,allpipes,transferpumps,compressors, collection pondsortanksforthesegregation oftreated.oruntreated wastes,ionexchangecolumns,orcarbonabsorption units);(2)Accidents causedbyhumanerrorornegligence; or(3)Othercauses,suchasactsofnature.Thepermittee shallnotifytheRegionalAdministrator andtheStateAgencyimmediately bytelephone andinwritingwithinfivedays.Thewrittennotification shallincludethefollowing pertinent information.'1)
Causeofnon-compliance; (2)Adescription ofthenon-complying discharge including itsimpactuponthereceiving waters;(3)Anticipated timethecondition ofnon-compliance isexpectedtocontinue, orifsuchcondition hasbeencorrected, thedurationoftheperiodofnon-compliance; (4)Stepstakenbythepermittee toreduceandeliminate thenon-complying discharge; and(5)Stepstobetakenbythepermittee topreventrecurrence ofthecondition ofnon-compliance.
Permittee shalltakeallreasonable stepstominimizeanyadverseimpacttonavigable watersresulting fromnon-compliance withanyeffluentlimitation specified inthispermit,including suchaccelerated oradditional monitoring asnecessary todetermine thenatureandimpactofthenon-complying discharge.
Nothinginthispermitshallbeconstrued torelievethepermittee fromappropriate civilorcriminalpenalties fornon-compliance.
