Reference:

AW-80-53 By letters identified below Southern California Edison Company (SCE) requested that certain documents prepared by Westinghouse Electric Corporation (WEC) related to the steam generator repair program at San Onofre Unit 1 be withheld from public disclosure pursuant to 10 CFR 2.790. These requests for withholding are supported by your affidavit (AW-80-53), notarized September 15, 1980, which was transmitted by your letter dated September 12, 1980 (R. Weismann to D. Eisenhut, NRC).

This transmittal' letter also includes a nonproprietary version of the report.

3/20/81 Letter from R. Weisemann, WEC to D. Eisenhut, NRC consisting (CAW-81-16) of request for withholding of document identified above and resubmitting the supporting affidavit (AW-80-53).

These documents describe the WEC design of the sleeves which are to be installed in San Onofre Unit 1 steam generators. The documents also include the design analysis, the test verification program and descriptions of the expanded mechanical plug, the rolled plug and the channel-head decontamination process.

The reason stated for the withholding of the information is that the information is owned and has been held in confidence by WEC, the public disclosure of.which would cause substantial harm to your competitive position because (1) it'W'ould result in the loss of valuable patent rights, and (2) itwould enhance the ability of competitors to design, manufacture, verify and sell steam generator repair techniques for commercial power reactors without commensurate expenses.

You also state that to the best of your knowledge this information is not available in public sources.

W have.reviewed the requests and related documents based on the requirements and criteria of 10 CFR 2.790(b) and have determined that the above-mentioned information sought to be withheld contains proprietary commercial information.

We.also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of WEC's competitive

,-,position. Accordingly, we have determined that the information should be withheld from public disclosure.

We, therefore, approved the requests for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding from public-inspection proprietary docu ments relating to the steam generator repair program at San Onofre Unit 1 transmitted by letters previously identified. Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the basis for withholding this information from public disclosure should change in the future such that the information could then be made available for public inspection, you or Southern California Edison Company should promptly notify the NRC.
