In accordance with your letter dated July 1, 1986, we have. terminated review of your' June.22. 1982 application to receive unitradiated nuclear fuel assemblies for the Midland Plant Units 1 and 2.
Materials License Nos. SNM-1904 and SNM-1905, which were issued on September 1, 1982, authorized possession and use of enriched uranium in fission chambers for Units 1 and 2.
Because neither Unit will be completed as a nuclear station, the fission chambers should be disposed of and the license terminated in accordance with 10 CFR 70.38(b). A copy of 10 CFR Part 70 is enclosed.

and Construerson General officos: 1945 West Parnell Road, Jackson, MI 49201 * (S17) 788-0453 July 1, 1986 John G Davis, Director Office of Nuclear Material Safety and Safeguards US Nuclear Regulatory Commission Washington, DC 20555 MIDLAND PLANT - UNITS 1 AND 2 PART 70 LICENSE APPLICATION DOCKET NOS 70-2964 AND 70-2965 FILE 1300, 0485.2, 0485.11 SERIAL 32745 On June 22, 1982, Consumers Power Company applied for Special Nuclear Material licenses to receive, inspect, possess, store and transfer unirradiated nuclear fuel assemblies for and at its Midland Plant Units 1 and 2.
Recently, the Company's board of directors authorized conversion of Unit 1 to a gas combined-cycle power production facility. Neither Midland unit will be completed as a nuclear facility. The Company intends to abandon those portions of the plant that are not usable for conversion to a gas-fired facility.
Although some review work was performed on our application, the requested l
licenses have not been issued. In light of the Company's decision not to j
complete the units as nuclear units, we hereby request that withdrawal of our i
application for the fuel licenses be approved, pursuant to 10 CFR Section 2.107.
Previously issued licenses for fis~sion chambers and by-product materials to be used in connection with the plant will be handled separately.
