Submission of revised SAR sections
By letter dated June 26, 2024 GNS submitted the response on the second request for additional information on the CASTOR geo69 Spent Nuclear Fuel Transportation Package. The NRC afterwards raised several issues which were discussed in clarification calls between NRC and GNS and resulted in required changes in the Safety Analyses Report. Enclosed to this letters are the on this basis revised sections of the SAR.
The revised SAR contain certain information that is proprietary, confidential and a trade secret to GNS. Therefore, a non-proprietary version of the SAR together with an affidavit prepared pursuant to 10 CFR 2.390 providing the basis for withholding of the GNS proprietary information from public disclosure is enclosed to this letter.

I, Dr.-lng. SASCHA KLAPPERT, depose and say that I am the Divisional Director of Engineering of GNS Gesellschaft fur Nuklear-Service mbH (a company duly organized under the Germa n Law, having its seat at Frohnhauser Strasse 67, 45127 Essen, Germany), duly authorized to execute this affidavit.
We, Dr.-lng RAINER NORI NG and Dr.-lng. SASCHA KLAPPERT, have reviewed or caused to have reviewed the information which is identified as confidential and referenced in the paragraph be low. We are submitting this affidavit in conformance with the provisions of 10 CFR 2.390 of the Commission 's regulations for withholding this information.
The information sought to be withheld from public disclosure is contained in En closure 2 of letter T1213-C0-00023 and are listed below:

This documents has been appropriately designated as proprietary.
We have personal knowledge of the criteria and procedures utilized by GNS Gesellschaft fur Nuklear Service mbH in design ating information as a proprietary trade secret, privileged or as confidential commercial or financial information.
Pursuant to the provisions of paragraph (b) (4) of Section 2.390 of the Commission ' s regulations, the following is furnished for consideration by the Commission in determining whether the information sought to be withheld from public disclosure, included in the above referenced document, should be withheld.
(1) The inform at ion sought to be withheld from public disclosure invo lves certain design details associated with the SAR analyses and SAR drawings of the CASTOR geo69 package design, w hic h are owned and have been held in confidence by GNS Gesellschaft fur Nuklear-Service mbH.
(2) The information is of a type customarily held in confidence by GNS Gesellschaft fur Nuklear Service mbH and not customarily disclosed to the publ ic. GNS Gesellschaft fur Nuklear-Service mbH has a rational basis for determining the types of information customarily held in confidence by it.
(3) The information is being transferred to the Commission in confidence under the provisions of 10 CFR 2.390 with the und erstand ing that it is to be received in confidence by the Commission.
( 4) The informat ion, to the best of our knowledge and belief, is not available in public sources, and any disclosure to third parties has been made pursuant to regulatory provisions or conf identiality agreements wh ich provide for maintenance of the information in confidence.
( 5 ) Public disclosure of the information is likely to cause substantial harm to the competitive position of GNS Gesellschaft fur Nuklear-Service mbH because :
(a) A similar product is manufactured and sold by competitors of GN S Gesellschaft fur Nuk lear Service mb H.
(b) Development of this informat ion by GNS Gese llschaft fu r Nu klear-S ervice mb H required expend iture o f considerab le resources. To the best of o u r knowledge and be lief, a competitor wo uld have to un dergo similar expe n se in ge n eratin g eq ui va lent inform atio n.
(c) In order to acq u ire such informat ion, a compe titor wou ld a lso require considerab le time and inconvenience related to th e deve lop m ent of a design a n d ana lys is of a cask for the dry storage and transport of spent nuc lear fuel.
(d ) The informat ion required significant effort and expense to obtain the licensing approvals necessary for app lication of the information. A vo idance o f this expe n se wou ld decrease a competito r's cost in app lying the information and marketing of the product to w h ich the information is applicab le.
(e) The informat ion consists of design features, analyses me thods and calculation results related to the design and analyses of a cask for the dry storage and transport of spent fuel, the app lication of w hich provide a competitive eco n omic advantage. Th e avai labi lity of such informatio n to co mpetitors would enable them to modify their product to unfair ly get a better competi tive position with GNS Gese llschaft fur Nuklear-Service mbH, take marketing or other ac tions to improve their prod u ct's pos ition or impa ir the pos ition of GNS Gesellsch aft fur Nuk lear-Se rvice mbH ' s product,
while avoiding the expense of deve loping similar data and analyses in support of their processes,
methods or apparatus.
(f) In pricing GN S Gesellschaft fur Nuk lear-Service mbH ' s products and services, significant research, development, enginee ring, analytical, licensing, qua lity assurance and other costs and expenses m u st be inc lu ded. The ab ility of GNS Gese llschaft fur Nuk lear-Serv ice mbH ' s competitors to utilize such information without similar expenditure of resources may enable them to sell at prices reflecting significantly lower costs.
