waste burial ground at the Western New York Nuclear Service Center near West Valley, New York.

'the possess. ion and dontrol of the West Valley facilities (footnote 13, Hearing Board decision). The DOE now provides security for all of the facilities, except' for the low-level burial ground which is the responsibility of The New York State Energy Research and Development Authority (NYSERDA). DOE continues to pump and treat water which collects in the trenches. Nuclear Fuel Services (NFS) will not be relieved of its' responsibilities until February 1983, when NYSERDA takes possession. The decision may be appealed by Dr.

Irwin Bross, Director of Biostatistics, Roswell Park Memorial Institute, Buffalo, New York, because of the roles of DOE and Westinghouse Electric Corporation.

2. The Sierra Club position on radioactive waste at West Valley, stated by Dr. Marvin Resnikoff (scientific consultant), is total exhumation and removal of radioactive materials from the site.
3. Proposed drilling project, to be undertaken during August - October, 1982, is intended as part of the on going site characterization program to assist in the evaluation of NRC's position. Analysis of the data to be obtained will help to determine site suitability.

WMLL will work with Tom Nicholson, ESB-RES, since continued use of the waste burial sites will be based on 10 CFR 61. Additional input is expected from USGS, DOE and New York State Geological Survey.

4. Congress was very explicit as to the NRC role in the West Valley Demonstration Project Act; however, additional clarification is needed with respect to the roles of DOE, New York State, USGS, and NRC Research, Waste Management, Fuel Cycle Divisions. The "amorandum of Understanding between the NRC and DOE recognizes
rdination between project manager for these agencies (R. Boyle is hdC contact).
5. Work characterization information provided in the West Valley EIS (00E/EIS-0081D) is not sufficient. The DOE must identify the wastes (type & quantity) so that a determination relative to site suitability can be made.
