General Details:
The U.S. Nuclear Regulatory Commission (NRC) held a public commenting meeting as part of the commenting process for the draft supplement to the environmental statement on the construction permit related to the operating license application for the SHINE facility. The meeting started at 6:00 p.m. CT and ended at 8:00 p.m. CT, although primary discussions were finished by 6:30 p.m. CT. The meeting began with a brief review of meeting ground rules, followed by a presentation by the NRC staff on the NRCs regulatory role, a brief background on the SHINE facility, details involving the environmental review, the staffs preliminary findings, and environmental review milestones, as well as how the public can submit comments. The presentations emphasized that comments provided on or before August 22, 2022, would be considered in the staffs work towards the final supplement. Any comments received after that date would be considered if possible. There was an opportunity for attendees to ask questions about the NRC staffs presentation followed by an opportunity for members of the public to provide oral comments on the draft Supplemental Environmental Impact Statement. One participant asked a question about the safety review.
Approximately 10 non-NRC staff attended the meeting. The participants included members of the public, as well as representatives of SHINE Technologies, LLC (SHINE),
Massachusetts Institute of Technology, and KL Gates, LLP.
Summary of Presentation:
The staff discussed that in 2015, the NRC and the U.S. Department of Energy, National Nuclear Security Administration (DOE-NNSA) issued NUREG-2183, Environmental Impact Statement for the Construction Permit for the SHINE Medical Radioisotope Production Facility, which discussed the environmental impacts of constructing, operating, and decommissioning the SHINE facility in Janesville, Wisconsin. In 2016, at the conclusion of its safety and environmental reviews, the NRC issued a construction permit for the SHINE facility. In July 2019, SHINE submitted to the NRC an application for an operating license for the SHINE facility.

When a final environmental impact statement (FEIS) has been prepared in connection with the issuance of a construction permit for a facility, the NRC is required to prepare a supplement to the FEIS in connection with any issuance of an operating license for that facility in accordance with title 10 of the Code of Federal Regulations (10 CFR) part 51.95(b). This supplement updates the prior environmental review and only covers matters that differ from those or that reflect significant new information relative to that discussed in the FEIS. Accordingly, in response to SHINEs operating license application, the NRC and the DOE-NNSA staff have considered whether there is any new information with respect to the environment or the environmental impacts of the SHINE facility, including information that is different from that considered in NUREG-2183. The NRC staff did not identify any information that presents a seriously different picture of the environmental consequences of constructing, operating, and decommissioning the SHINE facility.
After weighing the environmental, economic, technical, and other benefits against environmental and other costs, the NRC staffs preliminary recommendation, unless safety issues mandate otherwise, is that the operating license be issued as proposed. The NRC staff based its recommendation on the following:
- the application, including SHINEs supplemental environmental report;
- consultation with Federal, State, Tribal, and local agencies;
- the staffs independent review; and
- the consideration of public comments.
The staff ended the meeting by stressing that the closing date for submitting comments on the draft supplement is August 22, 2022. In addition to providing comments at the meeting, comments can be: (1) mailed to the Office of Administration Mailstop TWFN7A60M, U.S.
Nuclear Regulatory Commission, Washington, DC 20555-0001; (2) submitted online using the Federal Rulemaking website at regulations.gov (Docket ID: NRC-2022-0135); or (3) submitted electronically by email to SHINEEnvironmental@nrc.gov.
Action Items/Next Steps:
The NRC staff will address any comments received during the commenting period as part of the licensing of the SHINE facility. The NRC staff will develop and publish a final Supplement to the Environmental Impact Statement to NUREG-2138, NRCs Regulatory Role SHINE Background Environmental Review Preliminary Findings Environmental Review Milestones Submitting Public Comments. The NRC staffs responses to the comments received on the draft supplement will be included in appendix A of the final supplement.
Concurrently, the NRC staff will also be preparing a safety evaluation report which documents the staffs independent safety evaluation.
