Background

  • In the early 1980s, the NRC added new reporting requirements in 10 CFR 50.72(b) for licensees to immediately notify the NRC of potentially significant nonemergency events at nuclear power plants
  • In 2000, the NRC last updated this regulation 5

Background (cont.)

  • NEI submitted a petition for rulemaking (PRM) in 2018 requesting removal of nonemergency reporting requirements
  • NRC received 16 comment submissions
  • The NRC Recommended to the Commission:

- Consider rulemaking

- Determine whether reporting can be reduced or eliminated

- Balance the need to maintain situational awareness and visibility and openness to public stakeholders

  • Commission directed staff to pursue rulemaking

- Do not shift responsibility to resident inspectors 6

Status of Rulemaking Activity

  • The NRC staff is developing a regulatory basis document

- Discusses regulatory issues and alternatives to resolve them

2. Licensees are required under 10 CFR 50.73 to submit detailed reports for most of the event notifications. Would these reports be adequate?

4. How are event reports contrary to the best interests of the public and contrary to the stated purpose of the regulation?
