OFFICE REVIEW AND CONCURRENCE ON FINAL RULE PARTS 20, 30, 40, 70, AND 72, TERMINATION OR TRANSTER OF LICENSED ACTIVITIES: RECORDKEEPING REQUIREMENTS in a memorandum dated November 3,1995, you requested review and concurrence on rulemaking on the disposition of certain records upon termination or transfer of licensed activity. You also requested concurrence on a memorandum to transmit the Federal EggljLtet notice on the final rule. On November 20, 1995, a meeting was held between the Office of Nuclear Material Safety and ,

Safeguards and the Office of Nuclear Regulatory Research, to discuss the rulemaking and issues of concer.1 to the Division of Waste Management. On November 21, 1995, another meeting was held to discuss further the specific types of records being addressed in the rulemaking. In response to your request, and in light of the outcome of the November 20 and 21 meetings, concurrence is provided for the rulemaking, with the understanding that the attached example revision to the records retention rule is incorporated in the appropriate effected sections of Title 10.

REVISION TO RECORDS RETENTION RULE

7. In 5 30.51, paragraph (d) has been added to read as follows:

6 20.51 Records.

(d) The licensee shall retain each record that is required by the regulations in li 20.2107 and 20.2108 until the Commission terminates each pertinent license requiring the record.
