14 The item is SECY 98-140. The Commission is being 15 asked-in this paper to act on a-memorandum and order which I

16 would affirm the licensing board's decision in LBP 9720, in 17 which the board denied Envirocare of Utah, Inc.'s request

-18 'for a hearing and leave to intervene to challenge a 19 materials license. amendment granted to the Quivera Mining

20 Company.

21 Each of you has voted to approve the memorandum 22 and order which affirms that decision. May I ask you to 23 affirm your votes.
