3 CHAIRMAN DICUS: Good afternoon, ladies and 4 gentlemen. This is an affirmation session. We have one 5 item to come before us this afternoon. Before I ask the 6 Secretary to lead us through this item for affirmation, do 7 any of my colleagues have any opening comments that they 8 would like to make.

9 Madam Secretary, please proceed.

10 MS. VIETTI-COOK: The Commission is being asked to 11 act on a final rule amending 10 CFR 76 to make the 12 certification renewal and amendment processes more effective 13 and efficient.

l 14 This final rule modifies the process for l

15 certificate renewals, establishes a process for a 16 certificate amendment comparable to the process currently 17 used to amend a fuel cycle license, revises the appeal 18 process for amendments, eliminates the distinction between a 19 significant and non-significant designation for amendments, 20 simplifies the criteria for persons who are eligible to file 21 petitions for review of amendment actions, removes 22 references to the initial applications because the initial 23 certificates have been issued, and lengthens the time 24 periods associated with filing petitions for review and 25 Commission review of directors' decisions.

4' Commissioner Diaz voted to approve the publication 5 .and implementation of the final rule but would have 6 preferred to modify 10 CFR 76.37 to require publication of 7 the Federal-Register notices.to announce all filings of 8 applicat' ions for certification renewal or' amendment.

21 adjourn, have an affirmation, and the audience would have

22. left. I think it's important for our public, the 23 stakeholders, to see that we do vote on these issues and 24 that they are important. So I thank you for graciously 25 agreeing to change our way of doing business.
