4 NOTICE OF VIOLATION University of Illinois Docket No. 50-151 As a result of the inspection conducted on October 8, 1986, and in accordance with NRC Enforcement Policy, 47 FR 9987 (March 9, 1982), the following violation was identified:

10 CFR 50.59, Changes, Tests, and Experiments, requires prior Commission approval to any change in the facility or procedures described in the safety analysis report if it involves a change in the technical specifications incorporated in the licensee. Any change in the technical specifications shall be submitted as an application for an amendment to the licensee.

Technical Specification 3.5, Reactor Safety System, requires that the Standard Control Rod Positions interlock be operable during reactor Steady-state mode operation to prevent withdrawal of a transient rod when the standard control rods are not fully inserted.

Contrary to the above, on September 8 and 9, 1986, the reactor was operated

, in the Steady-state mode in a manner in which the Standard Control Rod Position interlock would not always prevent the withdrawal of the transient rod as described in the safety analysis report and license and prior commission approval was not requested by submittal of a license amendment.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
