D NOTICE OF VIOLATION University of Illinois Docket No. 50-151 Advanced Triga Reactor-
_ License No R-079 During an NRC inspection conducted on June 23-26. 1997, a violation of NRC Policy and Procedure for NRC Enforcement Actions." NUREG-1600, the violation requirements was identified.
In accordance with the " General Statement of is listed below:
Technical Specification'(TS) 6.1.2 a.1 specified, in part, that "... when the reactor is not shutdown... a licensed reactor operator shall be in the control room."
Additionally. 6.1.2.c.1 specified. in part, that " initial startup and approach to power" are " events requiring the presence at the facility of a senior reactor _ operator."
Contrary to the above, the NRC identified that one individual, whose license
-had expired on November 30, 1996, had held both the reactor operator and senior reactor operator positions from November 30. 1996 to March 21, 1997.
This_is a Severity Level IV violation (Supplement I).
The NRC has concluded that the information regarding the reaso_n for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence, and the date when full compliance was achieved is already adequately addressed on the docket in the attached inspection report.
However you are required to submit a written statement'or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or. your position.
In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation." and send it to the U.S. Nuclear Regulatory Commission. ATTN:
Document Control Desk. Washington. D.C. 20555, with a copy to the inspector at the Region III address, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
