NRC COMMENTS ON BNFL, INC INITIAL SAFETY ANALYSIS REPORT in acco:Jance with our agreement in the January 29,1997, Memorandum of Understanding (MOU) between the U.S. Department of Energy (DOE) and the U.S. Nuclear Regulatory Cornmission, I am providing initial comments from our review of the Initial Safety Analysis Report A 4 (ISAR), dated January 12,1998, that was sub!.t.ed to you by BNFL, Inc. Midway through the review, a separate, two velume Technical Report A 2 (dated January 23,1998) supporting the ISAR was received. The NRC staff's initial comments on the ISAR, as supported by the Technical R6 port, are found in the enclosure. Due to the expedited schedule of the BNFL review and the requirement for a separate, expedited review of the recently submitted LMAES ISAR documentation, the NRC staff may return and continue their review of the BNFL ISAR at a later date as time pennits, and thus may provide additional comments in the future.

In accordance with the MOU, we have focused our comments on those items which may impact the health or safety of the public, workers, or the environment, consistent with normal NRC practice, or which we have assessed could lead to an inconsistency with the NRC's reguiatory approach. The NRC did not review areas of the ISAR related to contractuel consistency between DOE and BNFL, Inc., which are considerert outside the purview of NRC's role as defined by the MOU.
