NRC COMMENTS ON LMAES INITIAL SAFETY ASSESSMENT PACKAGE in accordance with our agreement in the January 29,1997, Memorandum of Understanding (MOU) between the U.S. Department of Energy (DOE) and the U.S. Nuclear Regulatory 4 Commission, I am providing initial comments from our review of the Initial Safety Assessment Package (ISAP), dated January 24,1998, that was submitted to you by Lockheed Martin Advanced Environmental Systems, Inc. (LMAES). The NRC staff's initial comments resulting from the review of the ISAP are found in the enclosure. Due to the expedited schedule of the LMAES ISAP review, the NRC staff may retum and continue their review of the LMAES ISAP at a later date as time permits, and thus may provide additional comments in the future.
In accordance with the MOU, we have focused our comments on those items which may impact the health or safety of the public, workers, or the environment, consistent with normal NRC practice, or which we have assessed cou:d lead to an inconsistency with the NRC's regulatory approach. The NRC did not review areas of the ISAP related to contractual consistency between DOE and LMAES, which are considered outside the purview of NRC's role as defined by the MOU.
