APPENDIX A

NOTICE OF VIOLATION

CTI, Inc. License No. 50-19202 01

During an NRC inspection conducted on August 9-11, 1988, certain violations of

NRC requirements were identified. In accordance with the "General Statement

of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix  !

C (1987), the violations are listed below:

A. 10 CFR 34.11(d)(1) requires, in part, that the licensee's inspection  ;

program must include observation of the performance of each radiographer

during an actual radiographic operation at intervals not to exceed three ,

months.  ;

Contrary to the above requirement two radiographers during the first

quarter of 1988 and one radiographer during the second quarter of 1988 i

did not receive this inspection while performing radiography during  ;

these time periods.

This is a Severity Level IV Violation (Supplement VI).  ;

8. License Condition 18 states, in part, that except as specifically

provided otherwise in this license, the licensee shall conduct its

program in accordance with the statements, representations, and

procedures contained in the documents including any enclosures, listed in

the application. The application dated August 24, 1987 with the revised

Radiation Safety Program which includes Section 7.4.1 entitled "Training r

'

Program" states, in part, that Periodic Training and Safety Meetings will

be M1d at intervals not to exceed twelve months and that records of

these meetings will be maintained. l

Contrary to the above requirements, at the time of the inspection, three  ;

radiographers who performe.d radiography for the licensee in the year 1987 !

had not received this additional training.

This is a Severity Level IV violation (Supplement VI).  !

C. 10 CFR 20.408(b) states, in part, that when an individual terminates  !

employment with a licensee described in paragraph (a) of this section,  !

"

the licensee shall furnish to the Director, Office of Nuclear Regulatory

Research, USNRC, Washington, D.C. 20444, a report of the individual's .

exposures to radiation and radioactive material incurred during the  !

period of * ployment or work in the licensee's facility. Such report i

shall be fu *shed within 90 days of termination. l

Contrary to the above requirements, at the time of the inspection, a [

report had not been sent to the Director, Office of Nuclear Regulatory  :

Research 'or an individual who terminated work with the licensee in l

December of 1987. I

4 D. 10 CFR 20.407 states, in part, that each person described in section

j 20.408 of this part shall, within the first quarter of each calendar

year, submit to the Director, Of fice of Nuclear Regulatory Research,

q USNRC, Washington, D. C. 20555, a statistical summary report of the

] personnel monitoring information recorded by the licensee for individuals

for whom personnel monitoring was either required or provided.

Contrary to the above requirement, at the time of the inspection, the ,

i licensee had not provided the Director, Office of Nuclear Regulatory  ;

Research with the required report for the year 1987.

J transmitting this Notice. This reply should be clearly marked as a "Reply to  !

I a Notice of Violation" and should include for each violation: (1) the reason ,

J for the violation if admitted, (2) the corrective steps that have been taken f

j and the results achieved, (3) the corrective steps that will be taken to avoid  !

further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice,
