ACCEPTANCE OF THE AUGUST 24, 2020, WASTE CONTROL SPECIALISTS LLC REQUEST TO EXTEND THE POSSESSION TIME OF LANL WASTE IN THE EXEMPTION ORDER CONDITION 8.B.4 UNTIL DECEMBER 23, 2022 (CAC NO. 001542/DOCKET NO. 070-7005/EPID NO. L-2020-LLO-0006)

Dear Mr. Cartwright:

On August 24, 2020, Waste Control Specialists LLC (WCS) sent a letter to the U.S. Nuclear Regulatory Commission (NRC) requesting relaxation of Condition 8.B.4 of the currently effective NRC Exemption Order to WCS. In the letter, WCS requested permission to possess U.S.

Department of Energy (DOE) Los Alamos National Laboratory (LANL) Waste at the WCS Low-Level Waste Site (WCS Site) near Andrews, Texas, until December 23, 2022. The publicly available WCS Request is available in the NRCs Agencywide Documents Access and Management System (ADAMS) as Accession No. ML20237F462.

The NRC has completed its acceptance review of the WCS Request and will proceed with the detailed technical review. The NRC expects to complete its safety and environmental review with issuance of an NRC letter to WCS by October 30, 2020, under Condition 11 of the 2014 Order to WCS.

If there are emergent complexities or challenges in our review that would cause changes to the schedule, then the reasons for the changes and the new schedule will be communicated to WCS and Texas.

In accordance with Title 10 of the Code of Federal Regulations (CFR) Section 2.390, Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/readingrm/adams.html
