To inform the Commission of the staff's intention to send a letter to the Department of Energy (DOE) regarding a proposal to provide nuclear, technology and services to the Democratic People's Republic of Korea (DPRK). .

DISCUSSION:  !

DOE has forwarded for review a request under 10 CFR Part 810 from Sargent &

Lundy (Attachment 1--96NK003) to provide nuclear technology and services to '

the Korean Peninsula Energy Development Organization (KED0). The request is an integral part of the implementation of the U.S.-DPRK Agreed framework and the DPRK-KED0 Supply Agreement to provide two light water reactors to the l DPRK. )

1 The proposal is similar to the recent Part 810 requests from Combustion l Engineering Inc., Stone & Webster Engineering Corporation, and Raytheon Engineers and Constructors for which the Commission posed no NRC objection, given the President's approval of the underlying Agreed Framework between the United States and the DPRK. (See SECY-96-040 and SECY 96-104.) The staff believes that the issues involved in the earlier cases have been thoroughly addressed. Accordingly, the staff does not believe it necessary for the  !

Commission to visit these issues again and concludes that the subject case  !

meets the statutory requirements for approval of a Part 810 request in light il of its consistency with and support of U.S. obligations under the Agreed Framework and Supply Agreement. DOE will impose the same conditions on the subject authorization as approved for the earlier cases.
