DOE PART 810 REQUEST FROM DUKE ENGINEERING TO PROVIDE TECHNOLOGY i

AND SERVICES TO THE DEM0CRATIC PEOPLE'S REPUBLIC 0F KOREA PURPOSE:

l To inform t'he Commission of the staff's intention to send a letter to the 4 Department of Energy (DOE) regarding a proposal to provide nuclear tec,hne-logy 2 and services to the Democratic People's Republic of Korea (DPRK).

DISCUSSION:

Duke Engineering & Services, Inc., a subsidiary of Duke Power Company, has

- requested DOE authorization under 10 CFR Part 810 (Attachment 1 -96KN004) to provide to the Korean Peninsula Energy Development Organization (KED0) nuclear

. technology and services in connection with the reactor project in North Korea.

'The proposal would be part of the implementation of the U.S.-DPR,K Agreed Framework and the DPRK-KE00 Supply Agreement for the supply of two light water reactors to North Korea.

The subject request _is similar to recently granted DOE Part 810 authorizations for Sargent & Lundy, Comb,ustion Engineering, Stone & Webster, and oavtheon to participate in the KEDO project. The Commission posed no NRC ob' .tions to

? these approvals, given the President's approval of the underlying Agreed Framework between the U.S. and the DPRK.

The staff believes th'at the policy issues and proliferation c0ncerns raised in j these earlier cases were thoroughly addressed by the Commission and that there j have been no changed circumstances since their review. (See SECY-96-040, SECY t

96-104, SECY-96-126). Accordingly, the staff does not believe it necessary ,.

for the Commission to visit these issues again and agrees with DOE's conclusion that the subject case meets the statutory requirements for approval of a 10 CFR Part 810 request in light of its consistency with and support of U.S. obligations under the Agreed Framework and Supply Agreement.
