SUBJECT:
PROPOSED REVISION TO 10 CFR 73.71, SAFEGUARDS REPORTING REQUIREMENTS The Division of Rules and Records (DRR) has reviewed the proposed rule to amend Part 73 and concurs in this rulemaking. A DRR-marked copy is enclosed for ycur information.
Since arch, when DRR last reviewed this proposed rule, a final rule for Part 51 has been published.(March 12, 1984; 49 FR 9352) which requires'new boilerplate statements regarding the environmental impact. It appears, after reviewing 651.22(c)(3), that this proposed rule would be eligible for categorical exclusion. A boilerplate statement to that effect is attached to the marked copy behind page 3 of the Ccmnission Paper and page 4 of the Federal Register notice. On page 4 of the Regulatory Analysis, the sentence under 2.2 should be modified, since $51.5(a)(10) no longer exists. 1.'e recor: end that you consult with your ELD attorney to verify that the categorical exclusion is applicable to this role.
