On 10/17/2002 at 1121 hours0.013 days <br />0.311 hours <br />0.00185 weeks <br />4.265405e-4 months <br />, with Unit 1 & 3 at 100% power and Unit 2 at 0% power, a member of the Oconee Nuclear Site's Regulatory Compliance staff opened a string-tie inter-office mail envelope and discovered that it contained a document classified as "Safeguards Information." At this time, the employee assumed control of the document and immediately notified a member of the licensee's Security staff. Security took possession of the "Safeguards Information" document at 1135 hours.

The document was "NRC Regulatory Issue Summary 2002-12i, Revision 1, Transport of Spent Nuclear Fuel Greater than 100 Grams." It had been received on site and repackaged with unclassified documents into the inter-office envelope on 10/16/2002 between approximately 1300 and 1500 hours0.0174 days <br />0.417 hours <br />0.00248 weeks <br />5.7075e-4 months <br /> by an individual who overlooked the "Safeguards Information" on the original inner-envelope.

The envelope was left in the site mail room overnight prior to delivery and discovery.

All of the above actions were within the Oconee Site Owner Controlled Area but exterior to the Protected Area.

The root cause was an inappropriate action due to oversight by the involved individual.

The individual was counseled per company policy.

This event is considered to have no significance with respect to the health and safety of the public.

EVALUATION:

Background

Mail delivered to the Oconee Nuclear Site Vice President is opened by one of three designated members of the licensee's clerical staff. Each member of the clerical staff designated to open mail has previously received instructions concerning the mailing process and actions required upon receipt of a document classified as "Safeguards Information." Prior to this event, Employee 1 had received "Safeguards Information" documents on numerous occasions.

On each of these previous occasions Employee 1: (a) exercised positive control of the "Safeguards Information" document as required by 10 CFR 73.21(d)(1); (b) immediately notified a member of the licensee's Security staff; and (c) hand delivered the "Safeguards Information" document to a member of the licensee's Security Organization for storage in accordance with 10 CFR 73.21 (d) (2).

No indications exist to suspect that the "Safeguards Information" document was actually compromised and viewed by an unauthorized individual. However, the "Safeguards Information" document was not controlled in accordance with the requirements of 10 CFR 73.21(d)(2). Therefore, this event is considered to be a discovered vulnerability in the safeguards system meeting criteria listed in 73 Appx G I.(c) and is being reported under 10CFR 73.71(b) (2), which references 73.71(a) (4), and (d).

Description of Event The following is a chronology of the security event reported by Oconee Nuclear Station to the NRC Operations Center via the Emergency Notification System at 1303 hours0.0151 days <br />0.362 hours <br />0.00215 weeks <br />4.957915e-4 months <br /> on 10/17/2002 (EN#39297).

10/16/2002 Between approximately 1300 and 1500 hours0.0174 days <br />0.417 hours <br />0.00248 weeks <br />5.7075e-4 months <br />, Employee 1 opened a package containing "Safeguards Information" mailed by the Nuclear Regulatory Commission to the Oconee Nuclear Site Vice President. The document marked "Safeguard Information" was placed in a string-tie inter-office mail envelope which also contained other unclassified documents.

Causal Factors The investigation of this event did not indicate any malevolent intent on the part of the licensee clerical employee (Employee 1) or other involved employees. Employee 1 had been trained and was knowledgeable of the process and expectations concerning the receipt of "Safeguards information" mailed from the Nuclear Regulatory Commission. Additionally, on numerous occasions prior to the uncontrolled "Safeguards Information" event on 10/16/2002, Employee 1 had received "Safeguards Information" documents mailed to the Oconee Nuclear Site. On each of these previous occasions Employee 1 acted in an appropriate manner to positively control "Safeguards Information" as required by 10 CFR 73.21(d) (1).

The evaluation of the facts of this event leads to the conclusion that the cause of this event was a human error on the part of a trained and knowledgeable employee.

CORRECTIVE ACTION:

Immediate:

The "Safeguards Information" document was controlled as required by 10 CFR 73.21(d) (1) and 73.21(d) (2).

Subsequent:

1. The Employee l's immediate supervisor has initiated disciplinary action in accordance with established licensee policy.
2. The process and expectations for receipt of "Safeguards Information" have been re-communicated to Employee 1.

There was no safety significance associated with this event as the investigation of this event did not indicate any malevolent intent on the part of any individual or actual compromise of information contained in the "Safeguards Information" document.

ADDITIONAL INFORMATION There were no releases of radioactive materials, no personnel injuries, and no reportable equipment failures associated with this event.

This is not a recurring event.
