SEABROOK STATION, UNIT NO.1 - WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NO. MB4748)

Dear Mr. Warner:

By letter dated March 22, 2002, North Atlantic Energy Service Corporation (NAESCO), as the then licensee for Seabrook Station, Unit No. 1 (Seabrook Station), applied for an amendment to the Seabrook Station Facility Operating License No. NPF-86. On November 1, 2002, the Nuclear Regulatory Commission (NRC or the Commission) approved the transfer of the license for Seabrook Station, to the extent held by NAESCO, and certain co-owners of the facility, on whose behalf NAESCO was also acting, to FPL Energy Seabrook, LLC (FPLE Seabrook). By letter dated December 20, 2002, FPLE Seabrook requested that the NRC continue to review and act upon all requests before the Commission that had been submitted by NAESCO. The proposed March 22, 2002 amendment request would have modified the facility technical specifications pertaining to spent fuel assembly storage. Subsequently, by letter dated September 15, 2003, you withdrew the amendment request.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

7590-01-P UNITED STATES NUCLEAR REGULATORY COMMISSION FPL ENERGY SEABROOK, LLC DOCKET NO. 50-443 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSE The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of FPL Energy Seabrook, LLC (licensee) to withdraw its March 22, 2002, application for proposed amendment to Facility Operating License No. NPF-86 for the Seabrook Station, Unit No. 1, located in Rockingham County, New Hampshire.

The proposed amendment would have revised Technical Specification (TS) 3/4.9.13, Spent Fuel Storage, and associated TS figures and index.

The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on May 14, 2002, (67 FR 34489).

However, by letter dated September 15, 2003, the licensee withdrew the proposed change.

For further details with respect to this action, see the application for amendment dated March 22, 2002, and the licensee's letter dated September 15, 2003, which withdrew the application for license amendment.
