U.S. Nuclear Regulatory Commission Public Meeting Summary December 17, 2019

Title:

Public Meeting to Discuss the Status of Rulemaking to Align Licensing Process and Lessons Learned from New Reactor Licensing Meeting Identifier: 20191133 Date of Meeting: November 21, 2019 Location: NRC One White Flint North, Commission Hearing Room, 11555 Rockville Pike, Rockville, MD Type of Meeting: Category 3 Purpose of the Meeting:

The purpose of the meeting was to discuss the status of rulemaking to align licensing processes and lessons learned from new reactor licensing as described in SECY-19-0084, Status of Rulemaking to Align Licensing Processes and Lessons Learned from New Reactor Licensing (RIN 3150-AI66) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19161A169).

General Details:

Prior to the meeting, NRC staff reached out to three non-governmental organizations, six industry organizations, and four representatives from industry to notify them of the meeting, and to request participation. The meeting was noticed on the NRC public website (see meeting notice and agenda listed under References below).

The meeting was scheduled from 1:00 p.m. - 3:00 p.m.; however, the meeting adjourned at 2:10 p.m. after the conclusion of the question and answer period. The meeting was co-facilitated by Ms. Shelia Ray, an NRC in-house facilitator.

Approximately 68 people participated in the meeting. This included 31 people who were present during the meeting. There were 37 people participating in the meeting remotely using a teleconference line. A list of attendees is provided as an attachment to this meeting summary.

Summary of NRC Presentation:

Ms. Anna Bradford, Director of Division of New Reactor and Renewal Licensing provided opening remarks. Mr. Jim ODriscoll, Project Manager, Division of Rulemaking, Environmental, and Financial Support, Office of Nuclear Materials Safety and Safeguards provided an overview of the rulemaking process, status, and schedule (see NRC presentation and meeting transcript listed under References below). The NRC staff then opened the meeting for questions and comments from the public. After conclusion of the question/comment session, the NRC staff summarized next steps and concluded the meeting.

Public Participation Themes:

Remarks were shared by industry stakeholders Mr. Michael Tschiltz, of the Nuclear Energy Institute (NEI), Mr. Gary Becker of NuScale, and Mr. Joe Shea of the Tennessee Valley Authority. They discussed several topics of interest and requested clarification on how each was screened and whether they were within the current scope (see meeting transcript and NEI handout listed under References below).

The NRC staff then opened up the discussion for a general question and answer session.

Several stakeholders including Westinghouse, Framatome, Oklo, Platts, and NEI presented questions to the NRC. The NRC provided several clarifications and identified a few comments to take back for further consideration. Themes presented by the public included, but not limited to, the timing of rule in relation to upcoming applications, verifying scope of technical requirements to align Title 10 of the Code of Federal Regulations (10 CFR) Parts 50 and 52, maintenance of PRAs, the use of the 10 CFR 50.59-like process vs 10 CFR 50.59 including the inclusion of severe accident issues, and separating 10 CFR Parts 50 and 52 issues into two separate rulemakings.

The stakeholders communicated that they appreciated the information presented by the NRC staff, the opportunity to discuss their respective comments on the rulemaking efforts, and the NRC staffs responses to the comments and questions.

Action Items/Next Steps:

  • The NRC staff will complete the regulatory basis and issue it for public comment in late 2020.
