Dear Administrative Judges:

In accordance with the Atomic Safety and Licensing Boards (Boards) direction during the Track 2 evidentiary hearing on November 17, 2015, this letter provides the Board with input from the State of New York (New York), Riverkeeper, Inc. (Riverkeeper), Entergy Nuclear Operations, Inc. (Entergy), and the U.S. Nuclear Regulatory Commission (NRC) Staff (collectively, the Parties) regarding the schedule for post-hearing briefing. Based on consultations held this week, the Parties jointly propose the following due dates:

  • Proposed corrections to the hearing transcript: January 8, 2016
  • Proposed Findings of Fact and Conclusions of Law: February 29, 2016
  • Replies to proposed Findings of Fact and Conclusions of Law: March 30, 2016 The Parties respectfully submit that the proposed schedule is reasonable given the recent publication of the hearing transcripts, the upcoming holiday season, restrictions on expert witness availability, the anticipated issuance in January of the draft supplement to the Final Supplemental Environmental Impact Statement for this proceeding (which will require a detailed review by the Parties), and the involvement of NRC Staff counsel in an unrelated hearing in

Administrative Judges December 4, 2015 Page 2 January involving a license amendment for the Turkey Point facility. Accounting for all of these considerations, the Parties believe the above schedule is appropriate.
