Semiannual Fitness for Duty Program Performance Report Cooper Nuclear Station, Docket No. 50-298, DPR-46

Dear Sir or Madam:

The purpose of this letter is to submit Nebraska Public Power District's fitness for duty program semiannual performance report for Cooper Nuclear Station (CNS) for the period of July 1, 2008, through December 31, 2008. This report is submitted in accordance with the provisions of 10 CFR 26.71(d) which existed prior to issuance of the new 10 CFR Part 26 final rule on April 30, 2008. As stated in the final rule published in the Federal Register, licensees may defer implementation of this rule (except for Subparts I and K) until March 31, 2009. CNS has not yet implemented the revision to 10 CFR 26; therefore, this report is based on the regulation that existed prior to April 30, 2008.

SUMMARY

OF FITNESS FOR DUTY ACTIVITIES FOR JULY THROUGH DECEMBER 2008 POSITIVE RESULTS:

There were three positive test results during this reporting period.

PRE-ACCESS:

There were three positive pre-access test results during this reporting period. *One of these tests was reported in the "Other" category as it was the result of a Direct Observation due to low temperature during a pre-access test.

RANDOM:

There were no positive random test results during this reporting period.

FOLLOW-UP:

There were no positive follow-up test results during this reporting period.

FOR-CAUSE/POST-ACCIDENT:

Six for-cause/post-accident tests were performed during this reporting period with no positive results.

FOR-CAUSE/OBSERVED BEHAVIOR:

Two for-cause/observed behavior tests were performed during this reporting period with no positive results.

RANDOM TESTING RATE:

The random testing rate for this reporting period was 22.3%.

RANDOM TESTING RATE FOR 2008:

The random testing rate for 2008 was 56.4%.
