JOINT MOTION REGARDING TIMING OF

SUMMARY

DISPOSITION MOTIONS NextEra Energy Seabrook, LLC (NextEra) has prepared motions for summary disposition of Contentions 4B and 4D, which to avoid any question of compliance with 10 C.F.R. § 2.323(a), NextEra intended to file on May 6, 2013 - ten days after the April 26, 2013 release of the NRCs second draft supplemental environment impact statement for Seabrook reviewing the updated analysis of severe accident mitigation alternatives. During NextEras consultation with the parties pursuant to 10 C.F.R. § 2.323(b) to determine whether any resolution of the issues raised in these contentions is possible, the representative of the New England Coalition and Friends of the Coast (NEC/FOTC) has requested that NextEra not file this motion before noon on May 10, 2013, in order to allow NEC/FOTCs representative time to confer with NECs Board on this matter. The NRC Staff has no objection to this request.

Accordingly, NextEra, NEC/FOTC and the NRC Staff hereby jointly move the Board to accept the parties agreement that NextEra may submit its motions for summary disposition of Contentions 4B and 4D on May 10, 2013, and that the twenty-day period in which answers may be submitted pursuant to 10 C.F.R. 2.1205(b) shall run from the date of that submittal.

NEC/FOTC and the NRC Staff have reviewed this joint motion and have authorized NextEra to file it on their behalf.
