PETITIONERS WITHDRAWL OF MOTION OF OCTOBER 28, 2011 FOR LEAVE TO SUPPLEMENT BASIS OF CONTENTION REGARDING NEPA REQUIREMENT TO ADDRESS SAFETY AND ENVIRONMENTAL IMPLICATIONS OF THE FUKUSHIMA TASK FORCE REPORT Beyond Nuclear, New Hampshire Chapter of the Sierra Club and Seacoast Anti-Pollution League (Intervenors) hereby withdraw the October 28, 2011 Motion For Leave to Supplement Basis of Contention Regarding NEPA Requirement to Address Safety and Environmental Implications of the Fukushima Task Force Report. The Petitioners contention had been dismissed by the October 19, 2011 Memorandum and Order of the Atomic Safety and Licensing Board (ASLB).
Petitioners apologize for the inconvenience and the unnecessary expenditure of resources of the Licensing Board and of all parties connected with the proceeding because of the petitioners error.
While the Petitioners acknowledge that it is unfortunate that Petitioners error was not captured earlier by the October 26, 2011 consultation communications as per 10 C.F.R.
§ 2.323(b) with NextEra and NRC staff, the Petitioners understand that it is not the responsibility of the other parties to explicitly cite procedural errors being contemplated by the Petitioners.
