NOTICE Due to the lapse in government funds, the litigants in the captioned matters are advised that, as of today, these matters are suspended until the NRCs funding has been restored.1 All filing deadlines in the captioned matters are therefore automatically extended by the number of days that the NRC is shut down. This automatic extension applies to all deadlines in these pending matters before the Commission and the Atomic Safety and Licensing Boards. For purposes of calculating the duration of an automatic extension, for each day on which the NRC is shut down for all or any portion of the day (beginning October 9, 2013), one day shall be added to the time for filing or service of a document. This extension does not apply to any deadlines that passed before the NRC shut down.

Any hearings, status conferences, or other matters scheduled with a Board for a day when the NRC is shut down will be postponed. Once the NRC reopens, the Board will reschedule the postponed event.

1 While the NRC will continue to perform certain limited excepted functions, the agency is considered shut down for purposes of this notice until funding is restored.

Notwithstanding the foregoing, any participant wishing to make a filing in an adjudicatory matter during the pendency of the shutdown is requested to serve the document via the NRCs E-filing system, if practicable. In addition, the participant is requested to transmit that filing by e-mail to hearingdocket@nrc.gov.
