Dear Administrative Judges:

Last night the State attempted to file a motion for leave and a proposed contention (NYS-

40) via the NRC Electronic Information Exchange, but was unable to do so for as yet undetermined technical reasons. Instead, the State provided the submission via email to the Board and counsel for Entergy and NRC Staff. This morning the State will seek to upload last nights filing to the EIE. We will also circulate a revised certificate of service.

I apologize for this filing problem and for the resulting inconvenience to the Board and the parties.
