December 6, 2016 EN 16-026 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Northern States Power Company, Minnesota EA-16-175 Monticello Nuclear Generating Plant Docket No.: 50-263

ISSUANCE OF A NOTICE OF VIOLATION AND FINAL SIGNIFICANCE DETERMINATION PROCESS FINDING This is to inform the Commission that a Notice of Violation (NOV) will be issued on or about December 12, 2016, to Northern States Power Company (the licensee), for a violation associated with a White Significance Determination Process finding identified during an inspection of the Monticello Nuclear Generating Plant. The White finding, an issue of low to moderate safety significance, involved the licensees failure to plan and perform maintenance affecting the safety-related High Pressure Coolant Injection (HPCI) system, a condition adverse to quality, in accordance with written documents appropriate to the circumstances. Specifically, the licensee improperly planned and performed maintenance prior to April 2005 that initiated a crack in the safety-related HPCI oil pipe and, for numerous years, it failed to perform maintenance to resolve repeated identification of HPCI oil leakage.

The NOV is based on the licensees failure to meet the requirements of Title 10 of the Code of Federal Regulations, Part 50, Appendix B, Criterion XVI, Corrective Action, which requires, in part, that conditions adverse to quality are promptly identified and corrected. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a White finding.

On September 15, 2016, the NRC issued a preliminary determination letter for this issue, provided the licensee the results of the inspection, and offered the opportunity to attend a Regulatory Conference or respond in writing. In a letter dated October 14, 2016, Northern States Power acknowledged that a performance deficiency occurred; however, the licensee disagreed with its characterization. After considering the additional information provided by the licensee, the NRC has concluded that the associated finding is appropriately characterized as White.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
