August 26, 2013 EN 13-031 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Northern States Power Company, Minnesota EA-13-096 Monticello Nuclear Generating Plant Docket No.: 50-263

Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) will be issued on or about August 29, 2013, to Northern States Power Company, Minnesota for a violation associated with a Yellow Significance Determination Process finding identified during an inspection of the Monticello Nuclear Generating Plant (Monticello). This Yellow finding, an issue of substantial safety significance, will require additional U.S. Nuclear Regulatory Commission (NRC) inspections. The finding involves Northern States Power Companys failure to maintain a procedure addressing all of the effects of an external flooding scenario at Monticello.

Specifically, Monticello failed to maintain flood Procedure A.6, Acts of Nature, such that it could support the timely implementation of flood protection activities within the 12-day timeframe credited in the design basis as stated in the updated safety analysis report. Northern States Power Companys corrective actions included, but were not limited to, the acquisition of materials needed for flood mitigation and procedure revision to enhance the feasibility of actions.

A Notice of Violation is included based on Northern States Power Companys failure to meet Technical Specification Section 5.4.1, which requires, in part, that written procedures be established, implemented, and maintained covering the applicable procedures recommended in Regulatory Guide 1.33, Revision 2, Appendix A, February 1978. Regulatory Guide 1.33, Revision 2, Appendix A, Paragraph 6 addresses Procedures for Combating Emergencies and Other Significant Events and lists Item w, Acts of Nature (e.g., tornado, flood, dam failure, earthquakes), as an activity under Paragraph 6 to be covered by written procedures. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a Yellow finding.

The NRC issued a preliminary determination letter for this issue on June 11, 2013. On July 11, 2013, Northern States Power Company provided a written response. After considering the additional information provided by Northern States Power Company, the staff concluded that the finding is appropriately characterized as Yellow.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
