REQUEST FOR ADDITIONAL INFORMATION ON ELECTRIC POWER RESEARCH INSTITUTE REPORT, NO. 3002005564, DEVELOPMENT OF GENERIC SCALING FACTORS FOR TECHNETIUM-99 AND IODINE-129 IN LOW AND INTERMEDIATE LEVEL WASTE

Dear Ms. Tran:

In an email dated June 19, 2018 (available in the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession No. ML19057A233), the Electric Power and Research Institute (EPRI) submitted the publicly available report, No. 3002005564 entitled, Development of Generic Scaling Factors for Technetium-99 and Iodine-129 in Low and Intermediate Level Waste, dated November 2015 (ADAMS Accession No. ML18172A263), for the U.S. Nuclear Regulatory Commission (NRC) staffs review and endorsement. The NRC staff accepted this document for technical review in letter dated July 19, 2018 (ADAMS Accession No. ML18197A414).

On February 12, 2019, the NRC held a teleconference with EPRI that was a general information exchange to ensure that the draft questions are understandable. There were no resulting changes to the enclosed request for additional information (RAI). Each RAI in the enclosure provides the basis for the request and how the additional information will assist the NRC staff in completing the review of the report. The NRC staff will document its conclusions in a technical evaluation report.

Separately, during the teleconference, the NRC staff informed EPRI of the distinction between endorsement of an approach and finding an approach acceptable for use for demonstrating compliance with the regulations. The NRC staff explained that endorsement means the NRC staff finds the approach acceptable and makes it the NRCs preferred method for demonstrating compliance. Whereas, finding an approach acceptable for use means the NRC finds the approach acceptable, but the NRC chooses not to take a position on whether that method is preferred. The NRC staff asked whether EPRI intended to seek NRC endorsement of the approach or, rather, to find it acceptable for use. EPRI indicated that reviewing the approach toward a finding of acceptable for use was appropriate.

Upon review of the information requested herein, the NRC staff and EPRI should decide if a follow-up meeting or teleconference is necessary to come to resolution on the RAIs. Consistent with the NRCs policy on openness and transparency, this meeting would be open to the public.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
