CONFIRMATORY ORDER EFFECTIVE IMMEDIATELYThis is to inform the Commission that the staff expects to issue a Confirmatory Order (EffectiveImmediately) on or about January 31, 2006, to Entergy Nuclear Operations, Inc., Indian Point Units 2 & 3. This action is based on the requirements of PL-109-58, 119 Stat 594, Section 651,170E(3)(b) of the Energy Policy Act (Act) of 2005, that directs the Commission to require that backup power is to be available for the emergency notification system of the power plant, including the emergency siren warning system, if the alternating current supply within the10-mile emergency planning zone of the power plant is lost. The Confirmatory Order willbecome effective immediately upon issuance.
