GAO REFERRAL - FTS ABUSE BY NRC EMPLOYEE Attached is the Office of Inspector and Auditor (OIA) Memorandum Report documenting an investigation concerning abuse of the FEDERAL TELEC0fHUNICA-TIONSSYSTEM(FTS)by Office of Nuclear Reactor Regula-tion, U.S. Nuclear Regulatory Connission (NRC).

This investigation was initiated as the result of an anonymous allegation made to the U.S. General Accounting Office who referred the allegation to OIA by letter dated June 21, 1985. The letter from GAO indicated that misuses Government telephones on an almost daily basis by telephoning and other persons. Each telephone call made by was allegedly 15-45 minutes in duration.

Our investigation further indicates that made personal FTS telephone calls during times when also claimed reimbursement for working overtime.

On October 11, 1985, the results of our investigation were presented to the Assistant United States Attorney, Baltimore, Maryland, for prosecutive con-sideration. Prosecution of this case was declined in favor of administrative remedies available to the NRC.

During the course of this investigation, provided information which indicated was aware used the FTS for personal telephone calls and that also used the FTS to make personal telephone calls. The information provided has been addressed in a separate OIA investigation.

CONCLUSION AND RECOMMENDATION The facts of this investigation substantiate the allegation that used the FTS for personal business. This abuse of the FTS by is an apparent violation of 18 USC 641 and is contrary to the provisions set forth in NRC Manual Chapter 0270-044.

It is recommended that appropriate administrative action be taken with regard to the conduct of in this matter.
