NORTHERN THUNDER, INC , MOT 10H FOR EXTENSION OF TIME in its Memorandum and Order dated December 1, 19'S (ALAB-509), the Boars mace certain rulings with regard to the procedure by whlen :ne racon issue . vill ce resol ed. First, the Board directed the intervenors in Sterling and Tyror.e to file by January 5, 1979 a particularized memorandum setting forth (1) the respects in which the Perkins record i. inaccurate or otherwise deficient with respect to radon release rates and concentration levels, together with the basis for the in-tervenors assertions and an assessment of the potential significance of the ident-ified deficiencias, (2) hetner a hearing is recessary to resolve the '9atters raised by the intervenors, and (3) what evidence the intervenors are prepa red to offer. Second, the Board directed any party in any of the pending prcceedings to sucmit a brief by January 16, 1979 (45 days from the date of ALAB-509) on why the Board's approach to the Perkins record is not acceptable.
Because of upcoming hearings before the 'disconsin Public Service Ccmmission, the submission schedule contained in ALA3-509 would -ork a hardshio on Northern Thunder Starting December 11, 1978, the 'disconsin Public Service Comission will hold hearinns on the question wnether the power which would be generated by Tyrone is needed in aestern 'disconsin. In additice, the 'disconsin Public Service femmission will consider whether Tyrone, if constructed, would a confer an econcmic or environmentai benefit on disconsin consumers. the primary anti-Tyrone litigant before the Public Service Commission. is such, lhrig's attendance at the Public Service C mmission hearings is a riecessity, Suen hearings will be held in Eau Claire.'disconsin and Madison, disconsin. Therefore, for the better part of the period from December 11, 1973 through January 10, 1979, inrig .ill not be at his home or office, but, rather_ will be in daily attendance at Wisconsin Public Service Ccmmission hearings.
Northern Thunder's particiapation io the resolution of the rad 0n issue is significant. As noted by the Board, Northern Thunder is one of two intervenors whien has identified deficiencies in the Perkins record with respect to rador i
releases and levels of radon concentratior,,
Northern Thunder believes the brief in response to the Board's "deminimus" approach to the radon issue raises a number of extremely significant considerations.
In adcition, has indicated in footnote to ALAB-509 this may be the only opourtunity for intervenors to brief the ques tion of the Board's "deminimus" theory , and that the 30ard's analysis of tne "deminimus" theory may be crucial in shaping the future course of tnese proceedings. Therefore. 't is imoerative Northern Thuncer has adequate time to fully brief the significant issues raised by tne B..ard's appracen to the radon question.

Ecology Actlon of Oswego and Northern Thunder will work together in this proceeding and will maxe identical filings. Because of the intervenors' limi ted f unds , t h ri g may, in effect, represent both Nerthern Thunder and Icology Action of Oswegc. Therefore, his participation in this proceeding takes on adced significance.
