Badger Safe Energy Alliance, I nc . 's Preliminary Answer to Dakota Conunissions' Motion to Defer Commission Action and Reauest for Hearino As counsel to Badger Safe Energy Alliance, Inc. ("BSEA") , in the above captioned matter, I am in receipt of the " Motion to Defer Commission Action, Petition to Intervene Out of Time, and Request for Hearing" filed jointly by the N0 rth Dakota Public Service Commission and the South Dakota Public Utilities Commiss ion (" Dakota Commissions") . I did not receive the Dakota Commissions' motion until August 2, 1980. Even then I received the motion as an attachment to the answer of the NRC Staff to the motion.
If the Commission is at all inclined, with or without a hearing, to grant the relief requested in the Dakota Commissions' motion, BSEA request 5an opportunity to respond to the motion. Such response would be filed at this time, but for the f act, due to long standing and unsiterable vacation plans, I cannot possibly serve BSEA's response until August 15, 1980. Upon returning from vacation, I will attempt to ascertain the position of the Conynission with respect to the Dakota Commissions' motion and then proceed accordingly. Needless to say BSEA opposes the motion of the Dakota Conrnissions.
