AEROTEST OPERATIONS, INC., CORRECTION TO ORDER APPROVING INDIRECT TRANSFER OF LICENSE AND CONFORMING AMENDMENT RELATING TO AEROTEST OPERATIONS, INC., AEROTEST RADIOGRAPHY AND RESEARCH REACTOR (TAC NO. ME3120)

Dear Mr. Brisighella and Mr. Thams:

On July 7, 2010, the U. S. Nuclear Regulatory Commission (NRC) issued an Order Approving Indirect Transfer of License and Conforming Amendment Relating to Aerotest Operations, Inc.,

Aerotest Radiography and Research Reactor letter to you. This letter is to correct errors regarding the date of the Safety Evaluation and dates in the courtesy copy of the Federal Register Notice. Please disregard the letter dated July 7, 2010, and refer to this letter in the future.

By application dated January 19, 2010 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML100490068), Aerotest Operations, Inc. (Aerotest), X-Ray Industries, Inc., and Autoliv ASP, Inc., submitted an application to the U.S. Nuclear Regulatory Commission (NRC) as supplemented by letters dated February 2, March 23, April 1, and April 19, 2010, (ADAMS Accession Nos. ML100880295, ML100880338, ML100980153 and ML101120070, respectively), pursuant to Title 10 of the Code of Federal Regulations (10 CFR)

Sections 50.80 and 50.90 requesting approval of the indirect license transfer of Facility Operating License No. R-98 for the Aerotest Radiography and Research Reactor (ARRR) currently held by Aerotest. The indirect transfer would occur as a result of the sale of Aerotest, by Autoliv ASP, Inc., the parent company of Aerotest, to X-Ray Industries, Inc. The application also requested approval of the conforming amendment to the facility operating license pursuant to 10 CFR 50.80 and 50.90. Notice of the application was published in the Federal Register on May 14, 2010 (75 FR 27368). No written comments or requests for hearing were received from the public in response to the Notice. No physical changes to the ARRR facility or operational changes were proposed in the application.

Enclosure 2 provides the conforming amendment, which will be issued and made effective at the time the transfer is consummated.

contains the NRC staffs safety evaluation (SE) (Non-Proprietary version) and is the NRC staff=s SE (proprietary version) related to the preceding action. The Non-Proprietary version of the SE will be placed in the NRC public document room and added to the ADAMS Publicly Available Records System Library.

The Order has been forwarded to the Office of the Federal Register for publication.
