SUBJECT:

AEROTEST OPERATIONS, INC. - ORDER EXTENDING THE EFFECTIVENESS OF THE APPROVAL OF THE INDIRECT TRANSFER OF FACILITY OPERATING LICENSE FOR AEROTEST OPERATIONS, INC.,

AEROTEST RADIOGRAPHY AND RESEARCH REACTOR (TAC NO. ME3120)

Dear Mr. Brisighella and Mr. Thams:

The enclosed Order is being issued in response to Aerotest Operations, Inc.'s request dated September 3, 2010, for an extension of the effectiveness of the U. S. Nuclear Regulatory Commission's (NRC's) Order dated July 6, 2010. The July 6, 2010, Order titled, Order Approving Indirect Transfer of License and Conforming Amendment Relating to Aerotest Operations, Inc., Aerotest Radiography and Research Reactor consented to the indirect transfer of control of the Aerotest license to possess, use, and operate the Aerotest Radiography and Research Reactor, from its current owner, Autoliv ASP, Inc., to X-Ray Industries, Inc., pursuant to Section 50.80 of Title 10 of the Code of Federal Regulations.

The NRC staff has considered the information presented in Aerotests request and has determined that good cause has been shown to extend the effectiveness of the NRC's Order dated July 6, 2010, to October 15, 2010. The license amendment reflecting the change in ownership will be issued and made effective when the transfer is complete. The enclosed Order approves the extension and has been forwarded to the Office of the Federal Register for publication.

Sincerely,

/RA/
