SUMMARY

OF THE REACTOR OVERSIGHT PROCESS MONTHLY PUBLIC MEETING HELD ON NOVEMBER 18, 2020 On November 18, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff hosted a public meeting with the Nuclear Energy Institutes (NEIs) Reactor Oversight Process (ROP) Task Force executives, and other senior industry executives, to discuss the staffs progress on the ROP initiatives. The topics discussed during this teleconference are described below.

Treatment of Long-Term Degraded Conditions Mr. David Lochbaum, member of the public, presented his views on how the NRC could improve the feedback loop from the Accident Sequence Precursor (ASP) program to the ROP (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20315A396). The NRC staff followed with a brief summary of the existing regulatory options available to address long term exposure times (ADAMS Accession No. ML20318A172). Open discussion occurred after both presentations and there was general agreement that information from the ASP program is beneficial to improving the ROP. While the NRC staff believes there are existing means, even if not direct ASP feedback into the ROP, in which the ROP is reviewed and improved when degraded conditions are discovered that have existed for extended periods of time, the staff agreed that there could be benefit in a more direct feedback loop. No specific commitment for a review or changes were made but the NRC staff noted that if any changes are planned for implementation, they would be discussed at a future ROP monthly meeting.

Plan for Assessing COVID-19 Effects on the Inspection Procedure Program for the 2020 ROP Self-Assessment The NRC staff discussed the calendar year 2020 self-assessment activities, the COVID-19 inspection guidance that had been issued in April 2020 (ADAMS Accession No. ML20097E538) and May 2020 (ADAMS Accession No. ML20141L766), and the fact that it is already known that the ROP self-assessment program will have some red metrics due to the COVID-19 effects on the inspection program. Additionally, the staff discussed that two ROP self-assessment metrics will not be assessed this year (Inspector Objectivity and Performance Reviews by Supervisors and Resident Inspector Objectivity Visits to Other Sites), as described in the May 2020 inspection guidance memo. Inspection Manual Chapter (IMC) 0609, Appendix A, and IMC 0308, Attachment 3, Appendix A The NRC staff provided a summary of the proposed revisions to IMC 0609, Appendix A, The Significance Determination Process for Findings At-Power and its basis document, IMC 0609,, Appendix A, Technical Basis for the At-Power Significance Determination Process, in a presentation available under ADAMS Accession No. ML20295A269.

During the meeting, industry representatives expressed their desire to review the proposed revisions to IMCs before they are issued. Subsequent to the October 2020 ROP monthly meeting, the proposed draft revisions to IMC 0609, Appendix A, and IMC 0308, Attachment 3, Appendix A, were made publicly available under ADAMS Accession Nos. ML20308A592 and ML20308A601, respectively. During this meeting, the NRC staff answered questions from industry about the proposed revisions. Specifically, industry representatives asked about how single FLEX equipment failures would be handled and whether battery failures would require further evaluation using the revised FLEX screening questions. Industry representatives requested that an example of how to screen a single FLEX equipment failure finding be included in the revised basis document. The NRC staff plans to issue the revised IMCs by the end of the December 2020.

Performance Indicator (PI) Frequently Asked Questions (FAQ)

FAQ 20-02: Emergency Procedure (EP) 02, Emergency Response Organization (ERO) Drill Participation The NRC staff and industry discussed an extension to previously approved FAQ 20-02, EP ERO Performance Indicator, Revision 1, to extend the effective date to June 2021. This extension is due to the ongoing public health emergency associated with Covid-19. The FAQ extension was discussed and tentatively approved at the October 2020 ROP monthly meeting and was changed to final approved status at this meeting. The FAQ is available in ADAMS as Accession No. ML20317A113.

FAQ 20-04: Crediting Automated Notifications in the DEP Performance Indicator - Proposed NRC Response The NRC staff and industry discussed FAQ 20-04, Crediting Automated Notifications in the DEP Performance Indicator. This FAQ was discussed and tentatively approved at the October

2020 ROP monthly meeting and was changed to final approved status at this meeting. The FAQ is available in ADAMS as Accession No. ML20309A621.

Reactor Oversight Process Whitepaper - Modification of the Description of Unplanned Scrams with Complications Performance Indicator to Reflect AP1000 Design The NRC staff and industry discussed a white paper regarding the unplanned scrams with complications performance indicator guidance for AP1000 reactors. The white paper was discussed at the October 2020 ROP monthly meeting with a minor wording addition agreed upon by both the NRC staff and the nuclear industry and therefore the white paper was revised accordingly. The white paper will now move into the FAQ process for formal tracking of the future revision to performance indicator guidance documented in NEI 99-02, Regulatory Assessment Performance Indicator Guideline. This white paper is available in ADAMS as Accession No. ML20322A339.

Meeting Action Items None Communicating with the NRC staff At the start of all ROP public meetings, the project manager provides contact information for the public to use to provide their name as a participant in the meeting. This contact information is also provided for submitting questions and comments to the NRC technical staff. Please note that any questions and/or comments pertaining to the ROP project can be sent to Tekia.Govan@nrc.gov. Questions and/or comments will be forward to the appropriate NRC staff. The staff also mentioned the role out of the Contact Us about ROP page on the new ROP website, which can also be used to submit questions and comments regarding the ROP initiative (https://www.nrc.gov/reactors/operating/oversight/contactus.html).

Conclusion At the end of the meeting, NRC and industry management gave closing remarks. NEI expressed appreciation for the open dialogue and willingness of NRC staff to hear industry views. The NRC management stressed the importance of the NRC being focused on providing reasonable assurance of public health and safety when considering changes to the ROP.
