Dear Sir:

Enclosed are forty-three (43) copies of the report BAW-1490, Crystal River Unit 3, Licensing Considerations for Continued Cycle 1 Operation Without Burnable Poison Rod Assemblies.

This report justifies the continued operation of Crystal River No. 3 through the remainder of the first cycle with all burnable poison rod assemblies removed from the core. Orifice rod assemblies will be utilized in those fuel assemblies previously containing burnable poison rod assemblies except for eight locations. These eight locations correspond to the two fuel assemblies from which burnable poison rod assemblies previously escaped and their six symmetrical locations.

Section 6, Proposed Modifications to Technical Specifications, of the enclosed report is included for completeness of information only. A formal request for Technical Specification changes will be filed under separate letter accompanied by the appropriate licensing fee.

It is our belief that continued operation of Crystal River Unit No. 3 with the burnable poison rod assemblies removed represents no substantial safety hazard or unresolved safety concerns.
