The following documents are enclosed for official filing with the U.S. Environmental Protection Agency in accordance with the U.S. Nuclear Regulatory Commission regulations in Title 10 of the Code of Federal Regulations, Section 51.74:

1. Five copies of draft Supplement 38 to NUREG-1437, ?Generic Environmental Impact Statement for License Renewal of Nuclear Plants (GEIS),@ regarding the license renewal of Indian Point Nuclear Generating Unit Nos. 2 and 3.

2. Five copies of the U.S. Nuclear Regulatory Commission=s distribution list for draft Supplement 38 to NUREG-1437.

Simultaneously with this filing, a copy of draft Supplement 38 is being mailed to interested Federal and State agencies, industry organizations, interest groups, and members of the public.

A copy of this document has also been placed in the NRC=s Agencywide Documents Access and Management System (ADAMS). ADAMS is located on the NRC=s Web site at http://adamswebsearch.nrc.gov/dologin.htm. The Accession Numbers for the draft Supplement 38 to the GEIS are ML083540594 (Volume 1, main report) and ML083540614 (Volume 2, appendices). Please note that the public comment period for draft Supplement 38 to the GEIS ends on March 18, 2009.
