ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) associated with a White Significance Determination Process (SDP) finding will be issued on or around December 22, 2010, to Carolina Power and Light Company (Licensee) as a result of an inspection at Brunswick Steam Electric Plant, Units 1 and 2. This White finding, an issue with low to moderate safety significance, which may require additional NRC inspections, involved the Licensee's failure to implement its Emergency Plan to provide initial facility accident response through timely augmentation of on-shift staffing after declaration of an Alert at the Brunswick Steam Electric Plant. Specifically, on June 6, 2010, the Technical Support Center (TSC), Operations Support Center (OSC), and Emergency Operations Facility (EOF) were not timely activated in accordance with the Emergency Plan.

To meet this requirement, the Licensee's Emergency Procedures require activation of the OSC, TSC and EOF respectively within 60 - 75 minutes following the declaration of an ALERT or higher emergency classification. During the June 6, 2010 Alert, these facilities were activated after about two and one-half hours. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a White finding.
