COMPLETION OF COMMITMENTS OF CONFIRMATORY ACTION LETTER NO. 3-10-001

Dear Mr. Allen:

This letter is in response to your November 7, 2011, letter informing the U.S. Nuclear Regulatory Commission (NRC) that FirstEnergy Nuclear Operating Company (FENOC) had completed all actions required by the June 23, 2010, Confirmatory Action Letter (CAL) issued to the Davis-Besse Nuclear Power Station. The CAL (ML101740519) confirmed the following commitments by FENOC to the NRC:

1. Provide to the NRC, in writing, the results of the Reinspection Years calculation for Operating Cycle 17 performed in accordance with American Society of Mechanical Engineers (ASME) Code Case N-729-1 based on calculated RPV Head temperatures.

Due prior to plant restart (Mode 2).

2. Upon completion of destructive examination of the control rod drive mechanism nozzle ring samples removed from nozzles #4 and #10, quarantine one untested minimum full-length 90 degree sample and turn over ownership to the NRC. Quarantine the sample immediately until arrangements can be made to transport the sample to an independent laboratory selected by the NRC.

3. Beginning with reactor startup (Mode 2) and until reactor pressure vessel (RPV) head replacement, upon reaching Action Level 3 of EN-DP-01171, "Engineering Implementation of the reactor coolant system (RCS) Integrated Leakage Program," the plant shall be shut down in 30 days if RPV Head leakage cannot be ruled out. During subsequent shutdown as part of the containment inspection for RCS leakage, if RPV Head leakage cannot be ruled out, a bare metal visual examination of the RPV head will be performed per applicable ASME Code Case and 10 CFR 50.55a(g)(6)(ii)(D).

4. The licensee has voluntarily elected to shut down the unit no later than October 1, 2011, and replace the RPV head.

B. Allen On July 7, 2010, the NRC issued a letter (ML101880308) that closed Commitment No. 1 of CAL 3-10-001. Commitments No. 2 through 4 were assessed in Section 4OA5.4 of Inspection Report 05000346/2011004 (ML112991544). Based on our review of the CAL commitments and the results of our inspections, we consider Commitments No. 2 through 4 of the CAL to be closed and, therefore, conclude that FENOC has met all of the commitments contained in the June 23, 2010, CAL issued to Davis-Besse Nuclear Power Station.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS),

accessible from the NRC Web Site at http://ww.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
